Terms of Use

Last updated

These terms apply when you use Pocket Puzzles & Ink Tracing, our app for iPhone, and the books in it. By using the app you agree to them.

Who we are

The app is published by Adolfo Gastalver Rubio (NIF ES05294386Q), based in Spain. Write to support@adol.tech with any question about these terms.

The app's licence

The app is licensed to you under Apple's Licensed Application End User License Agreement (the Standard EULA), which covers your right to install and use it. These terms add what is specific to our app and its books. Where the two differ about the app as software, Apple's agreement applies.

The books

The app is free and comes with a free sampler. Other books are sold one at a time, and Premium unlocks every book, new ones included, and the premium inks, for as long as it lasts.

The books are ours: their puzzles, their covers, and their drawings as we prepared them, some of them from the public domain. You get a personal licence to read them, solve them and draw over them in the app, for your own non-commercial use. You may not copy them out of the app, share or sell them, or use them to make other products.

What you draw and write is yours. The book underneath stays ours.

We sometimes correct a book. When a puzzle had a mistake, correcting it clears the answers you wrote in that puzzle, since they may no longer be right. It does not touch your drawings.

Purchases and Premium

You buy books and Premium through Apple's In-App Purchase, under Apple's terms. The price is shown before you buy.

Premium is a subscription, monthly or yearly, that renews automatically. Payment is charged to your Apple Account when you confirm the purchase. Premium renews at the end of each period, at the price then current, unless you turn off auto-renew at least 24 hours before the period ends. A renewal is charged in the 24 hours before the period ends.

You can manage or cancel Premium in your iPhone's Settings: tap your name, then Subscriptions. While Premium is active, Manage Subscription in the app's Account tab opens the same place. Cancelling stops the next renewal, and Premium lasts until the end of the period you paid for.

When Premium ends, the books you did not buy on their own lock again, and the premium inks are no longer offered. Your work in those books stays on your phone and comes back if you subscribe again. A book bought on its own stays unlocked for good.

Apple handles refunds.

These terms do not take away any right you have as a consumer under the law where you live.

Your account

You can use the app without an account. Signing in with Apple lets your purchases follow you to another phone, and you can delete the account in the app at any time.

Keep your Apple Account secure: whoever can sign in to it can use your purchases.

Using the app fairly

Do not try to get around the purchase checks, download books that are not unlocked for you, take books out of the app, overload or attack our server, or take the app apart, except where the law allows it.

Changes to the app

We keep improving the app and the books, and we may change or remove features. We work to keep every book you have unlocked available to download. If we ever have to stop the service, we will say so in the app in advance.

Liability

We make the app with care, but we provide it as it is, without promising that it will always be available or free of errors.

As far as the law allows, we are not liable for indirect losses, and our total liability to you is limited to what you paid for the app's purchases in the twelve months before the claim. None of this limits a liability the law does not allow us to limit, such as for fraud, gross negligence, or death or personal injury caused by negligence, or your rights as a consumer.

Ending

You can stop using the app and delete your account whenever you like. We may suspend or close an account that breaks these terms.

Law and disputes

These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you can take a dispute to the courts there.

If something goes wrong, write to support@adol.tech first: most problems are quicker to solve that way.

Changes to these terms

When these terms change, the date at the top changes with them. If a change matters, we will say so in the app before it applies. If you keep using the app after that, the new terms apply.
